Trademark Opposition is a legal process by which any person can challenge a trademark application after it has been published in the Official Trademark Journal. Under Section 21 of the Trade Marks Act, 1999, any member of the public — customer, competitor, or individual — can file opposition within 4 months of journal publication.
Opposition is a more formal process than an examiner's objection, involving both parties submitting evidence and attending hearings. The Trademark Registrar adjudicates and either allows the application to proceed or rejects it.
Any person can oppose a trademark — even without being a registered trademark owner. Common opponents include:
