Trademark Transfer, formally known as Trademark Assignment, is the legal process of transferring ownership rights of a registered or pending trademark from one person or entity (the Assignor) to another (the Assignee). It is governed by Sections 37–45 of the Trade Marks Act, 1999.
After transfer, the assignee becomes the new legal owner of the trademark with all associated rights — to use the mark, license it, enforce it against infringers, and renew it. The assignment must be recorded with the Trademark Registry to be effective against third parties.
